More waiting - all we know is the judge did not specify anything more than the custody plea was denied. The prosecutor is trying to get more details from the judge. And, word is that Ms. Ouellet is planning to appeal.

Good news for Rusty and Pal!! I hope this is a precedence that other rescues can use in the future for the animals' benefit. Good work to all involved in this sad story.
I hope Ms Ouellet spends a lot of money on court fees and such and never gets her hands on defenseless animals again.

This really would be the first time that horses were seized due to unsafe conditions wouldn't it? Rusty and Palomino would be easy to place, I should imagine. They are both sweet natured and BEAUTIFUL!

I'm POd. Ouelett has enough money to retain a lawyer to go through the appeals process ... but doesn't use it to FEED and care for her ANIMALS? Grrr.... Shame shame shame on her.

We had some fun with these two today! Cat came over and we longed both of them with tack. The palomino has obviously been worked with but has issues. He is a good boy but is braced up front waiting for a big bit or heavy hands. He did settle in and after a bit was stretching and using his back more. He was excellent while being tacked and pitched a fit at first about being hosed but quickly gave in and even enjoyed himself at the end! Cat took pics and will post them later.........

Getting him ready to work... This is his "do we really have to?" face. *sigh* OK fine...jeez there better be carrots after this. Starting out with his head in the air... But trotting very cute! Relaxing down and showing us his potential But I don't WANT a bath! I do, however, want a drink.

Yes he has finally covered his ribs with a light layer of fat......he is a harder keeper than the Chestnut so I separated them and he gets fed by himself now but shares a paddock during the day with my mare Paris.....they get along well and he does not have to compete for food.

Still up in the air, but getting closer - from Geri:
"On September 24th there will be a hearing regarding who will take custody of Bev Ouellet's animals. The hearing was requested by Skagit County. I guess I'm not surprised that the judge has to make a formal statement rather than just adding to his original, brief decision that Bev was denied custody. The trial is scheduled for September 19th. With my limited knowledge of law, I hope that if Bev is found not guilty of some charges it doesn't change the custody issue. She doesn't seem to expect the return of her animals."
No word on any appeal from Bev Ouellet and I am hoping when she says she doesn't expect the return of her animals that means there won't be one.

The 19th date is actually going to be a pre-trial hearing on other charges (possibly the neglect charges). The criminal and civil trial along with the custody hearing will be on the 24th.

I have new information from the former owners on Pal as well. He is 7 years old, and was named Titan. He is broke, but does require a more experienced rider as he has a lot of "get up and go". He was gamed as well. He has tried to mount mares in the past - they speculated he might be proud cut (I have not seen evidence of this however). I have seen photos of him being ridden outdoors and he looks relaxed with a rider. He was purchased 3-4 months prior to the seizure at an auction, along with Rusty.
