What a bad turn of events, and in the end the one suffering the most is Shante. How severe is his wound. Will it impact his soundness for the future? If his injury was caused by the adopters trailer, I would hope that she would do the right thing and help with the vet bill. Even though she sent $48 dollars, that is not sufficient if you ask me. (Which you didn't ) Maybe there should be a trailer check done as well as a site check. It certainly is not your fault if her husband did not say anything about the email she was supposed to recieve about his heart. As someone also stated, the ultimate responsibility for making sure you are getting a sound horse is up to the buyer. They could of paid for a vet check at anytime. And I agree, a heart murmur is not that big of deal, unless she was planning on working him extra hard or doing endurance riding, which would not be advisable for a 27 year old horse anyway.

It's small claims, you wouldn't have attorney's fees. The costs are very minimal. I'd be more than happy to donate my services if you needed any help with the forms! But if you don't want to pursue that route, I understand. I just think it's unfair. Was she even asked to pay an adoption fee or was he a gift contract horse given his age? I love how people want to pay nothing or nearly nothing and get a sound, perfect horse with no health or behavioral issues.

Well, I'm horrified that anyone would turn their back after a horse was injured by their carelessness. I hope they're very ashamed of themselves, and by my reckoning, they definitely don't deserve Shante. It was a horrible way to find it out, but in a way this was a saving grace... if the heart murmur had been found out about at a later date, imagine what might have happened?! Actually angel, if the heart murmur had been discovered later (assuming they never did see the email), and they were concerned about it, we would happily taken Shante back. That is the difference between a rescue and a sale horse. We want good matches for our horses, and we want them to lifelong homes. Therefore we aren't going to force a horse on someone if he doesn't end up meeting their needs.
Of course, this is never the case when you buy a horse. Then it truly is buyer beware - if the horse doesn't meet your needs or an issue is discovered after the purchase (whether you did a pre-purchase vetting or not), you are basically SOL and will have to re-sell the horse yourself.

Heart murmer aside the horse was injured in their unsafe trailer. Period. If the heart murmer was the issue here, SAFE, as stated by Jaime would have taken the horse back and I would guess returned the adoption fee but I have not seen the contract so I am not sure about the fee. To me these are 2 separate issues. Asking her to pay the difference in the dollar amount of the adoption and vet bill seems very reasonable to me. Asking her to pay for the bandaging supplies and any future laceration related costs also seems reasonable.

I had a "silver lining" moment today when it occurred to me that if he did not drop of a heart murmer in the middle of a panic in a straight load that was lacerating him he certainly will last a long time packing little kids! ;D

Oh no! I hope hes doing better! I just was coming to say that I went to see him before I read his story so when I did read it I was just floored!! First off that he is 27, I never would have believed it to look at him! I assumed he was 15ish when I was out there. Secondly his before pictures, it just broke my heart to see him like that. Patti said he had gained weight, I had no idea! I sure hope hes healing up alright, hes such a doll.

Shante saw the vet today to have his stitches removed...the vet said that he is healing well, no infection, no effect on his mobility. I'm to continue to lightly banadage the wound for another week, and after that it should be healed enough to go without bandaging. SO we're on the right track...hooray!
I should also mention that Shante hauled just fine for me today...he hestitated a fraction of a second at the trailer door, but I just told him to keep moving, and he hopped right on. He was nervous, but he did just fine. He got right on the trailer just fine to come back from the vet, and all my horses greeted him happily when he got back home.
Plus he was as good as gold for the vet, even when he cleaned the wound. Shante is a very good boy.

Shante is doing just great. It took a while but his cut is almost completely healed now. He still has a scab on part of it, but there is also nice pink skin filling in. He moves just fine - the location of the cut does not seem to bother him. He's been staying at my place while in treatment, and it's been fun having him here. Shante is a major talker! Particularly at feeding time, he will carry on a long conversation with me...whinnying, nickering and snuffling. He's really funny. He's definitely low man on the toem pole around here -- even Buckie chases him (the former low man... ) He is ready for his new home now. He's a really nice horse that someone is really going to enjoy.
