And more:
"The Missouri Highway Patrol recommended that prosecutors file a misdemeanor charge of "careless and imprudent driving" against the truck driver, Richard Facinelli, 63, of Colorado. The truck overturned in a median after Facinelli tried to rouse his wife, who was sleeping in the passenger seat, said patrol spokesman Cpl. Al Nothum.
Ruth Facinelli, 56, was startled and pulled on her husband's arm, leading to the crash, Nothum said. The double-decker horse trailer was carrying 41 horses and a mule."

Wow, it appears that these horses may be owned by the same guy in Ft. Collins that owns the feedlot that Desert Spark was in!!!
Doesn't seem to be confirmed yet, but very likely. In fact, I wonder if Spark and the others would have been on that load if they weren't rescued....

I bet you are right Jaime! Ft. Collins is not that big of a place and I would think that it would be unlikely that there is more than one killer buyer in that small town! Do you remember me commenting on the mule in the backround of one of Sparky's pictures? I wonder if it is the same mule on the truck

OMG Connie...I bet you are right. I wonder if that palomino paint you could see in the background was there, she would stand out. It almost makes me want to call them and find out....

The fate of these horses remains up in the air as no one can reach the owner:
Unable to Reach Owner of Horses that Survived Accident Last Edited: Thursday, 28 Sep 2006, 9:13 PM CDT Created: Thursday, 28 Sep 2006, 9:12 PM CDT
Hundreds of people have offered to adopt the horses that survived Wednesday's crash on I-44. They were headed to an Illinois slaughterhouse to be turned into food for people in Europe. We've been able to track down the man who apparently owns the horses. He's a horse broker from Colorado named Charlie Carter who deals in horses shipped for slaughter. But, we haven't been able to reach him. Neither has the highway patrol or the Humane Society.

Curiousity got the better of me - I gave Amber a ring. It's the same guy.
But, probably not the same load with TB #4 on it. That was a full load going directly to Cavel with 40-some horses on it. That load left on Sunday.
He had another load that left on Tuesday. It had 4 TB mares on it, 2 older thin Belgian geldings, and yes, a cremello gelding.
However, he also ships horses from other locations. It still could have been from another feedlot.

She's going to try and contact him. Of course, she may not have any luck either, if he knows he's being looked for.

I just spoke again with Amber. She talked to the feedlot owner. He is aware of the accident, he says that the horses are no longer his and belong to the government. He has already sent off paperwork and apparantly the government now owns the horses. (I don't understand this, but this is what he said). He thought they would probably ship them, as they do not have Coggins or health certificates.
Also, the horses did not come from the Ft Collins feedlot. Amber speculated it was probably somewhere closer to where the truck was found.

Well, that part about the Coggins may not be true because I remember the wild horses that were saved by Ford and the other mare saved by Gail Vacca that was pulled off the truck at Cavel when her owners realized she had been bought by a killer in Canada. They do seem to make exceptions if they are quarantined.
This guy probably thinks that by washing his hands of them it will take the heat off of him!
